Winter Driving Tips from My Team and I

Winter weather seems to have arrived a little early in the Northern and Eastern parts of the country. With the news out of Buffalo about seven feet of snow, and the entire country reporting unseasonably low temperatures, it got me thinking about winter driving and how to potentially avoid crashes or injuries.

I asked my staff to share their winter driving tips*, and together we've created a list of our favorites to pass along to our readers.

Jess (Receptionist): Keep gas in your tank; ideally, you should have at least half a tank or more. Don't let it get below a quarter tank if you can avoid it.

Chrissie (Writer): Top up your windshield washer fluid before you leave your driveway! Also, invest in good wiper blades, they're worth it. And, scrape off your car… clear the snow from your windshield and lights and defrost the rear window before you leave.

Sean (Attorney): Drive with your lights on, always… day or night, good weather or bad.

Sue (Legal Secretary): Don't follow too close; leave yourself lots of room to stop. Obviously you should always do this, but it's even more important in bad or slippery weather.

Cris (Paralegal): Proceed with caution; slow down, it's not a race!

Kelly (Intake Specialist): Brake evenly when you need to. Avoid suddenly slamming on the brakes.

Eric (Attorneys): Stay home! If you don't need to go out, don't go out.

Finally, my tips:

Check your tires: make sure the pressure is right, look for cracks or embedded objects, and watch for wear.
Practice braking, turning, and other maneuvers in a safe place (like a parking lot) to make sure you know how your car is going to react in different weather conditions.
Keep an accessible emergency kit inside your car. Include: bottled water; non-perishable snacks; a small shovel; sand or kitty litter; a blanket; hat and gloves or mitts; a towel or paper towels; First Aid kit; jumper cables; a flashlight and batteries; and anything else you might need if you get stuck in your vehicle.

Michigan Senate Introduces New Car Seat Safety Bill

Parents, it looks like new car seat laws are coming to Michigan.

Last week, the Michigan Senate took the first steps towards changing car seat laws in Michigan when they sent an approved Bill (SB 1135) to the House. The bill would bring Michigan's car seat laws in line with recommendations by the American Academy of Pediatrics.

The highlights of the bill are as follows:

A child who weighs less than 30 pounds or is younger than 2 years old should be in a rear-facing car seat.
A child between 30 and 50 lbs or aged 2 to 5 years can use a forward-facing car seat.
A child shorter than 57 inches tall who weighs more than 50 lbs, or who is aged 5 to 10 years, can transition to a booster seat.

Speaking generally, a rear-facing seat is safer than a forward-facing seat; a forward-facing seat is safer than a booster; and a booster is safer than a regular seat with an adult seat belt. So really, the goal is to keep kids in the safest and most appropriate type of seat for their age, weight, and height.

Well now you can! The OSVehicle Tabby is an open source, build-it-yourself vehicle that you can buy online and build in less than an hour!

The pieces are shipped to the customer with instructional videos available online. The kit includes four wheels, two seats and an electric powertrain and battery pack. It can be purchased for $4,200.

However, this model does not include body panels, lights or a windshield, meaning the Tabby is not street legal. You can upgrade to the Urban Tabby model that is street legal, but only in the UK.

You will have the option to purchase an electric motor, gas engine or gasoline-electric hybrid and the Tabby will be able to reach speeds of 50 mph.

An article in the Huffington Post had this to say about the Tabby “Overall, the vehicle appears to be a unique way to bring inexpensive transit to the do-it-yourself crowd. It also looks like the perfect project for those who have yet to master the art of welding, but have graduated past building Legos.”

Recall: 3.8 Million Car Safety Seats

Graco is recalling 3.8 million car safety seats due to a buckle that may not unlatch. The National Highway Traffic Safety Administration (NHTSA) warned that the buckle may make it "difficult to remove the child from the restraint, increasing the risk of injury in the event of a vehicle crash, fire or other emergency."

The NHTSA has said that some consumers have had to cut the straps to remove children from the car seat.

The recall includes 11 models made from 2009 to 2013 by Graco Children's Products Inc. of Atlanta. The models are Cozy Cline, Comfort Sport, Classic Ride 50, My Ride 65, My Ride 70, My Ride 65 with Safety Surround, Size4Me 70, My Size 70, Head Wise 70, Smart Seat, Nautilus 3-in-1, Nautilus Elite and Argos.

According to the NHTSA this is the fourth largest recall of child seats in the U.S. and the is recommending that another seven infant car seats models that use the same buckles should also be recalled. They also began an investigation of EvenFlo child safety seats which have a similar design to the recalled buckles and may use buckles by the same manufacturer, AmSafe Commerical Products, Inc.

Graco has reported that food or beverages can make the harness buckle sticky and harder to use over time. They have not recalled the rear facing infant models because infants do not get food or drinks on their seat according to a Graco spokesperson.

Graco has released cleaning tips for the buckles and began sending replacement buckles to owners last year with instruction on how to replace them. They also have reported that there have no reported injuries from the defective buckle.

Parents should check seat buckles and contact Graco for a replacement if they have not already received one . See photo below for recalled buckles:

New Car Seat Changes for 2014

Since 2002, the Lower Anchors and Tethers for Children (LATCH) system has been in place to make child car seats easier to install. LATCH has attachments that use the lower anchors and tethers in vehicles and car seats instead of using seatbelts to secure the car seat.

However, the National Highway Traffic Safety Administration (NHTSA) is changing its recommended regulations.

Beginning February 2014, the lower anchors of the LATCH system should no longer be used if the combined weight of the child and car seat is 65 pounds or more, according to NHTSA. Once the maximum weight has been reached, the car seat must be used with a seatbelt.

The change is a safety precaution as vehicle manufacturers and some car seat makers cannot guarantee the strength of the anchors after the max weight is reached. Currently makers of child car seats list a maximum weight and height for children on models, but do not take into account the actual weight of the car seat.

Make sure to check the weight of your child, their seat and compare it to the the recommendations of the car seat itself and NHSTA.

Halloween Safety Tips

Halloween is a fun-filled, candy-eating, scare-bound night, but it is also a very dangerous night for children, pedestrians and motorists.

Deadly facts from Fatality Analysis Reporting System (FARS) from 1990-2010:

- 115 children were fatality struck by a vehicle on Halloween over the 21 years of the study.

- An average of 5.5 fatalities occur each year on Halloween.

- 70% of accidents happen in intersections or crosswalks.

"More people are struck by vehicles on Halloween than any other night of the year, especially between 4 and 8 p.m.," Michael L. Prince, Office of Highway Safety Planning (OHSP) director said. "Anyone out on Halloween night, regardless of age, should take extra care when walking or driving to prevent crashes and injuries."

Safety Tips:

Motorists:

- Limit distractions, especially passengers who may distract the driver.

- Travel slowly through neighborhoods and especially around curves or near cross walks.

- Enter and exit driveways with extreme caution.

- Keep an eye on pedestrians

Pedestrians:

- Cross only at marked intersections.

- Look left, right and left again before crossing a street.

- Wear reflective clothing or carry flashlights.

- Limit clothing or masks that could impair vision or ability to move.

- Use sidewalks if possible.

Trick-or-Treating:

- Plan a route in advanced.

- Wear comfortable shoes.

- Stay well-lit using reflective tape or flashlights.

- Make sure costumes are not long enough to create a tripping hazard or obstruct movement.

- Avoid masks that make it difficult to see or breathe.

- Check children's candy for choking hazards or tampering.

- Walk in groups or with trusted adults.

Oh Deer! Top 5 States for Deer Collisions

So begins the season of deer.

Recently, State Farm projected a driver will have a 1 in 174 chance of striking a deer and those collisions will cost an average of $3,414. They created a list of the top 30 states for deer collisions, projected collisions totals per state and the chance of collisions. See the list here.

Last year, 1,231,710 deer-auto accidents were reported.

Top 5 states for deer collisions in 2013:

1. West Virginia – Projected collisions: 28,968 / Chance of collision: 1 in 41

2. Montana – Projected collisions: 11,549 / Chance of collision: 1 in 65

3. Iowa – Projected collisions: 29,843 / Chance of collision: 1 in 73

4. South Dakota – Projected collisions: 8,083 / Chance of collision: 1 in 75

5. Pennsylvania – Projected collisions: 114,933 / Chance of collision: 1 in 77

Michigan falls number 10 on this year's list with projected collisions at 77,103 and a chance of collision of 1 in 91.

When do deer collisions occur?

November is the month mostly likely to hit a deer. It is prime hunting and mating season, creating an increase in deer movement. According to State Farm, about 18% off all deer accident will happen in November.

Deer accidents are 3 times more likely to occur on a day in November than any day between February and August. October is the second most likely month and December is the third.

Tips on how to avoid deer collisions:

- Deer generally travel groups, so if you see one there are probably more nearby.

- Pay attention to deer crossings signs. They are put in active locations.

- Remember that deer are most active during early morning and evening hours.

- Use high-beam lights as much as possible.

- Do not swerve if you are about to hit a deer. Losing control of your vehicle and going off the road or into the path of an oncoming vehicle could be far worse than hitting a deer.

- Car-mounted deer whistles are not always effective.

Keeping Fido Safe with Crash-Test Dummy Dogs

Recently, the nonprofit center for Pet Safety in Reston, Va., joined forces with Subaru to test 11 pet safety belts to find out which restraints work well enough to earn a seal of approval from pet-advocacy groups and to help establish a standard for pet restraints.

In a government product testing lab in Virginia, the pet harnesses went through various crash tests using some of the world's first crash-test dogs, simulating a 25-pound terrier mix, a 45-pound border collie and a 75-pound golden retriever.

The results were not promising. Only one harness consistently kept a dog restrained in the seat: Sleepypod's Clickit Utility Harness.

Subaru said it will soon offer the Sleepypod's Clickit Harness as an accessory in its vehicles, reports The Wall Street Journal.

Why is this necessary?

Unrestrained pets can create a safety hazard. “Pet advocacy group Bark Buckle Up argues that unrestrained pets act like missiles in accidents, endangering passengers and themselves. In one calculation by motorist-advocacy group AAA, even a 10-pound unrestrained dog in a crash at only 30 miles an hour will exert roughly 300 pounds of force,” said The Wall Street Journal.

Injured or disorientated pets thrown from a car crash may become violent or obstruct rescue.

“Nearly 90% of U.S. pet owners say they travel with their pets, but few strap them in, despite recommendations from the American Society for the Prevention of Cruelty to Animals and others. Some 17% of drivers surveyed in a 2011 AAA study admitted driving with a pet on their lap,” reports The Wall Street Journal.

Driving, Grilling and Fireworks... Oh My!

The 4th of July can be an exciting, fun-filled weekend, but it also holds impending dangers. Follow these tips for driving, grilling, fireworks and pets to have a safe and fun holiday!

Driving

The National Safety Council (NSC) estimated that 540 traffic fatalities and 57,800 injuries may occur due to motor vehicle collisions this 4th of July weekend.

It also is estimated that 196 lives may be saved this Independence Day holiday period by buckling up, and an additional 135 lives could be saved if all wore seat belts.

Here are some tips from the NSC to stay safe this holiday weekend:

Refrain from using cell phones while driving.
Put your cell phone on silent or in the glove box to avoid temptation.
Safely pull over and put the vehicle in park to take or make a call.
Always wear a safety belt – every trip, every time.
Make sure every passenger is wearing his or her safety belt before you begin your drive.
Have children sit in the back and use the proper child safety seat or booster seat.
Never leave a child or pet unattended in a vehicle, especially during hot weather.
If you plan to drink, designate a non-drinking driver.

Grilling

Every year people in the U.S. are injured while using backyard charcoal or gas grills. Follow these steps from the American Red Cross to safely cook up treats for the backyard barbecue:

Always supervise a barbecue grill when in use.
Never grill indoors – not in your house, camper, tent, or any enclosed area.
Make sure everyone, including the pets, stays away from the grill.
Keep the grill out in the open, away from the house, the deck, tree branches, or anything that could catch fire.
Use the long-handled tools especially made for cooking on the grill to keep the chef safe.
Never add charcoal starter fluid when coals have already been ignited.
Always follow the manufacturer's instructions when using grills.

Fireworks

The safest way to enjoy the 4th of July is to watch a public fireworks display conducted by professionals.

If fireworks are legal where you live and you decide to use them follow these safety tips from NSC:

Never allow young children to handle fireworks – older children should use fireworks only under close adult supervision.
Light fireworks one at a time, in a clear outdoor area away from onlookers, houses and flammable materials.
Do not aim fireworks at another individual and never place any part of your body over a firework.
Keep a bucket of water nearby to fully extinguish fireworks that don't go off or in case of fire, and do not try to re-light or handle malfunctioning fireworks.

Here are additional tips from the Red Cross:

Never give fireworks to small children, and always follow the instructions on the packaging.
Make sure the person lighting fireworks always wears eye protection.
Light only one firework at a time and never attempt to relight "a dud."
Store fireworks in a cool, dry place away from children and pets.
Never throw or point a firework toward people, animals, vehicles, structures or flammable materials.
Leave any area immediately where untrained amateurs are using fireworks.

Pets

Don't forget about your pet's safety this weekend too! Here are some tips from WHEC-TV to keep pets safe:

1. Keep picnic food away from pets: Did you know that avocado, chocolate, onions and garlic, fat scraps, raw meat, candy, and stone fruit pits can all be dangerous for dogs to consume? Be sure to keep all July 4th picnic food in spots where dogs can't access it. Keeping food in sealed containers can help, but smart dogs can open a food storage box. Since the biggest risk to dogs in the food department is licking plates of leftovers clean, be sure to put someone on used plate patrol. It also helps to keep picnic food trash in a garbage can with a tight-fitting lid.

2. Avoid leaving open containers of alcohol around: Dogs also can get intoxicated! Just a little alcohol can cause vomiting and diarrhea for a dog. Dogs don't know that they'll get sick from lapping up that delicious cup of strawberry margarita that they found on a lawn chair. But you'll know when you've got a puking doggie! So be sure to keep alcoholic beverages out of reach of pets.

3. Keep dogs out of the road: Folks are traveling to and from parties on July 4th, often under the influence (even though it is illegal). With guests coming and going through the backyard gate, it's pretty easy for a dog or cat to get out. Perhaps keep pets indoors on July 4th? Or at least keep tabs on their whereabouts.

4. Firecrackers and pets don't mix: In addition to not shooting your own eye out, please keep pets away from fireworks and firecrackers. Also, some dogs get very scared of the loud booms of fireworks displays. Maybe leave the dog at home when you go to your local fireworks display.

Here are some tips from The Dog Whisperer, Cesar Milan to avoid stress for your pet over fireworks:

1. Preparation.

Arrange to have your dog in a place where there won't be loud fireworks displays — a friend's or relative's home or a doggie day care with which your dog is familiar. If it's an unfamiliar place for your dog, take him over there a few times in the days before the holiday so that it won't be a surprise when you take him there on the Fourth.

2. Accommodation.

If you cannot take your dog to a place away from fireworks, then have a travel kennel at home for her to feel safe in. if you're not going to be home, have a friend or sitter there to keep your dog company and take her out to relieve herself every four hours.

3. Acclimation.

The best way to prepare your dog for fireworks is to make sure he's comfortable with the sound in advance. While this is a simple process, it can take time — possibly three or four months of playing the recorded sound of fireworks for your dog at an increasingly louder volume before he eats, before a walk, before affection and play, and condition him by association to hear the sound and interpret it as something good. While you can try this method over only a week or two, in such a short time span it should only be used in conjunction with one or more of the other tips. In any case, play the firework sounds.

4. Sedation.

If you do find it necessary to use medication or a thundershirt to calm your dog during the fireworks, remember that you must introduce any such tool at the right time, conditioning your dog to understand that the medication or thundershirt is there to bring them to a calm state. This means that you must bring your dog to that calm state first, and then introduce the tool — before the fireworks and the anxiety begin. If she is already at an anxiety level of 8 or 9, then her mental state will overrule the medication. If she is already breathing heavily, then the thundershirt, which is designed to slow her breathing, won't work. A tool is an intellectual thing we use with a dog's instincts. The challenge is knowing how and when to connect the two.

5. Communication.

If you are going to be with your dog during the fireworks, sending the calming message that they are nothing to worry about will also help him to relax. Remember, though, while humans communicate with words, dogs communicate with energy, and will look to their pack leader for clues on how they should behave. If you're not making a big deal or showing excitement about the fireworks, then he will learn to be less concerned as well.

Use and Learn Hand Signals to Keep Bicyclists Safe

As more and more bicycles hit the roads this summer, it is important for both bicyclists to use hand signals and motorists to pay attention to them.

Hand signals can also be useful when…

- Riding in groups to alert other bicyclists of your movement.

- Using any vehicle that does not have turn signals, like a moped.

- Your vehicle may have damaged turn signals.

- Operating a vehicle with hard to see turn signals, like a motorcycle.

Here is a reminder of the US hand signals:

Left Hand Turn

Stick left arm straight out, parallel to the ground. The National Highway Traffic Safety Administration recommends turning your head to make sure you have a clear path before executing the turn.

Right Hand Turn

Stick the upper part of your left arm straight out beside you, with your elbow bent at a right angle and your forearm vertical to the ground. Your hand is pointing straight up toward the sky. Basically, your left arm looks like the letter L.

Stick right arm straight out, parallel to the ground.

Slow or Stop

Let anyone who may be behind you know you're about to slow down or stop by placing your upper left arm parallel to the ground and your forearm down toward the ground. Basically, it is the opposite of the right-turn signal.

Click it or Ticket Campaign Begins this Week

Do you suffer from Buckle-phobia?

If so, there is only one clinically proven solution: the seat belt. “Recent studies show that wearing one inside a safety belt enforcement zone means you won't feel the side effects of a $65 ticket. Three out of three officers agree,” states a Click it or Ticket it ad campaign.

Beginning May 20 through June 2, Michigan will participate in the national campaign: Click it or Ticket. There will be safety belt enforcement zones, marked with a large portable sign, spread across the state searching for those with “Buckle-phobia.”

In 2008 and 2009, Michigan led the nation in seatbelt use, but has declined over the past few years. In 2012, seat belt use was at 93.6%, however, almost half of all people killed in vehicle accidents were not wearing seat belts.

Over 8 thousand seatbelt tickets and over 200 child restraint tickets were issued in Click it or Ticket enforcement zones last year.

Michigan law requires all drivers and passengers 15 and younger in any seating position to be buckled up. Children must be in a car seat or booster seat until they are 8 years old or 4 feet 9 inches tall.

So don't be caught with Buckle-phobia this Memorial weekend! Buckle up!

Proposed Bills to Decrease Auto Insurance in Michigan

In 2011, Michigan held the ranking for highest auto insurance rates in the U.S. State lawmakers from Detroit are trying to end that trend with proposed bills that will lower insurance rates.

Michigan has a no-fault insurance policy which guarantees personal injury protection payments to those injured in auto accidents.

Gov. Rick Snyder and other Republicans believe that the no-fault policy boosts insurance premiums and have created a plan to cap insurance payments at $1 million. They say this plan will reduce rates by $125 per vehicle for one year, with possible reductions in the future.

However, members of the Detroit Democratic Caucus say that the no-fault policy is only a small contributor to insurance rates.

“We have a rare opportunity to gain some momentum in creating more transparency for the MCCA [Michigan Catastrophic Claims Coalition, the body that administers funds for catastrophic auto injuries], which sits on $14 billion of our money but refuses to open their books,” State Representative Thomas Stallworth says. http://www.michiganradio.org/post/detroit-state-lawmakers-suggest-alternative-auto-insurance-changes

State Representative Phil Cavanagh is proposing legislation that would restructure the MCAA board to focus on public interests rather than insurance companies.

There are additional proposed bills that would require insurance companies to explain rate increases and stop insurance companies from sending vehicles to collision shops they own.

6 Percent Increase in Michigan Catastrophic Claims Association Premium Come July

REMINDER to Michigan drivers and motorcyclists: the Michigan Catastrophic Claims Association (MCCA) will be increasing the annual premium by 6 percent beginning July 1, 2013. The premium for Michigan motorists and motorcyclists will go from the current $175 to $186.

The MCCA is a non-profit association that has been in place since 1978. The purpose of the association is to reimburse auto insurers for personal injury protection benefits that stretch beyond $500,000. With the 6 percent increase come July, the threshold will reach $530,000. As the number of claims over $500,000 increases, so does the MCCA premium. The current $175 premium for 2012 represents a $30 increase from 2011. Factoring in the recent 6 percent hike yields an overall 21 percent increase from 2011 to 2013. Last year, a total of $947 million was paid out on catastrophic injury claims. The majority of these claims include brain and spinal injuries resulting in permanent disability to the injured.

As the MCCA premium continues to rise, lawmakers look to a no-fault reform in Michigan.

Ford Recall Affects Taurus, Lincoln MKS & Explorer Models

Ford will be recalling about 3,000 vehicles including the 2012 Taurus, Lincoln MKS, and 2013 Explorers.

During manufacturing, the seams on the fuel tanks may have only been partially sealed, causing potential for a fuel leak and sparking concern of fire risk.

There have been a small number of claims made for leaking fuel tanks; however there have been no reported accidents or fires due to the defect.

Notification of the recall will be sent out at the end of the month. Ford & Subaru Recalls in March

Ford Recall

Ford announced earlier this month its recall of nearly 196,500 minivans due to corrosion that prohibit the vehicle's row of third of seats from locking in place.

The models affected are the Freestar and Mercury Monterey minivans that were manufactured from 2004-2007. Only vehicle owners in the following states are affected by the recall: Connecticut, Delaware, Illinois, Indiana, Iowa, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, New Hampshire, New Jersey, New York, Ohio, Pennsylvania, Rhode Island, Vermont, West Virginia, and Wisconsin.

Although Ford believes the corrosion does not pose a threat of accident or injury, in a report to the National Highway Traffic Safety Administration (NHTSA) the company explains the reason for the recall is “to avoid a protracted dispute with the agency,” (Ford Recalling 196,000 Minivans for Corrosion Problem, Christopher Jensen, Wheels, New York Times, http://wheels.blogs.nytimes.com/2013/03/06/ford-recalling-196500-minivans-for-corrosion-problem/).

Subaru Recall

Subaru also announced a recall earlier this month of an estimated 47,000 cars and sport utility vehicles due to a malfunction that causes the engine to start on its own.

Models included in the recall are the Legacy Passenger and Outback SUV manufactured from 2010 to 2013, the Impreza manufactured from 2012-2013 and the 2013 XV Crosstrek SUV.

The engine can start on its own and run for up to 15 minutes. It can continue to run until the fob battery is exhausted or the vehicle runs out of gas, (Subaru recalls vehicles over engines that may start on their own, Donald White, Los Angeles Times, http://www.latimes.com/business/autos/la-fi-hy-subaru-recall-20130307,0,7452758.story).

BMW Recalls 570,00 Vehicles

BMW announced last week that it is recalling 570,000 vehicles in the U.S. and Canada. The basis for the recall is that the battery cable connector could fail resulting in the engine stalling.

The models affected are the 3-Series sedans, convertibles, coupes and wagons manufactured from 2007 to 2011. Besides the 3-Series, one of BMW's most popular vehicles, the 1-Series convertibles and coupes produced from 2008-2012 and the Z4 sports car from 2009 to 2011 are also included in the recall, (BMW recalls nearly 570,000 cars to fix cables, Associated Press, http://www.freep.com/article/20130216/BUSINESS01/130216011/BMW-recalls-nearly-570-000-cars-to-fix-cables?odyssey=nav|head).

The defect is that the connectors and fuse box in the recalled vehicles can begin to decay with use causing an electrical fail between the battery and fuse box. When such an electrical malfunction occurs there is then potential for engine failure.

There have been no reported injuries, but one minor car accident due to the defect in Canada.

Owners can take their vehicles into BMW dealers who will replace the damaged battery cable connector for free. The company will notify owners of the recall in March.

Chrysler Recalls 278,000 Vehicles

This past Thursday Chrysler announced a recall that will affect 278,000 pickups due to a defect with the rear axles.

Included in the recall are several Ram 1500 pickups from 2009-2012, Dodge Dakota pickups from 2009-2011 and Chrysler Aspen and Dodge Durango SUVs from 2009.

A nut in the rear axle has the potential to come loose as a result of missing adhesive. If this nut does come loose, the axle could lock causing the driver to lose control. Owners of vehicles will receive notification from Chrysler next month. For repair dealerships will put in a retainer to fasten the nut. This is the second recall the company has made regarding this issue. Last October 44,000 Rams and Dakotas were recalled due to a loose nut axle nut.

Avoid the Latest Michigan Phone Scams

Don't be fooled by the most recent phone and email scams in Michigan. The newest one is a person who claims to be from a local court calls to inform you that you have missed a jury date and there is now a bench warrant for your arrest, which can all be avoided if you pay $500 by credit card. Yes, when reading scenarios involving scams it may seem obvious, but the callers use intimidation techniques, panic sets in, and it can happen to anyone.

There have been a few variations of this scam going around Michigan, says State Court Administrator Chad C. Schmucker, but the most recent has been in Muskegon County, (Beware of scam phone calls, e-mails, Ingham County Legal News, http://www.legalnews.com/ingham/1372297/).

Should you receive a call like this, protect yourself by:

Be suspicious of any calls, e-mails, or texts who claim to be a court official.
Another hint it's a scam, if they ask for your social security number to avoid arrest.
Be leery if they ask for immediate payment to avoid arrest.
Do not give out any personal information such as social security, bank or credit card information.
Report any suspicious active to the authorities and call the court that the caller is claiming to be from. Besides attempting to scam victims out of money, callers can also be charged for posing as court officials.

Toyota Recall Affects 1 Million U.S. Cars

Toyota's name has taken a hit these past few years due to several recalls from brakes to floor mats, but most rececntly it took the title as number one in sales again over GM. However, yesterday Toyota announced a U.S. recall of 1 million vehicles.

Of the 1 million 752,000 are Corollas or Corolla Matrixes that were manufactured from December 2001 to May 2004. These vehicles are being recalled due to faulty airbags. Defective circuit boards that trigger the airbags could cause “a short, causing a buildup of heat or potentially causing the air bags or seat belt pretensioners to deploy when there hasn't been a crash,” (Toyota recalls 1 million Corollas, Lexus sedans, Chris Woodyard, USA Today, http://www.usatoday.com/story/money/cars/2013/01/30/toyota-recall-corolla-lexus-is/1876449/).

The second recall includes roughly 270,000 Lexus IS sedans produced from 2006 to 2012 for lose nuts on wiper blades that could cause them to fail if under substantial pressure.

Two crashes have been linked to the flawed airbags, but Toyota has not been able to confirm them. There have been 18 cases of abrasion injuries from the airbags, reports Toyota spokesman Naoto Fuse. (Toyota recalls 1 million Corollas, Lexus sedans, Chris Woodyard, USA Today).

Beyond the U.S. there have been thousands of vehicles recalled in Japan, Mexico and Canada.

Be Prepared for These Snowy Situations

One of the beauties of Michigan; you never know what the weather will bring. Today's combination of snow and ice can make driving a dangerous feat. Be prepared for the common jams below before venturing on the snowy-icy roadways.

If your rear wheels skid…

Take your foot off the gas.
Steer in the direction you want your front wheels to go. How do you know which way to turn? If your back wheels are veering to the left, steer left, and if they're veering to the right, steer right.
If as you begin to steer your back tires veer in the opposite direction, steer in that direction. You'll find you may need to go back and forth.
Do you have standard brakes? Gently pump them.
Do you have anti-lock brakes? Do NOT pump. Steadily apply pressure.

If your front wheels skid…

Take your foot off the gas.
Shift into neutral.
As the front wheels veer sideways, steer in the direction you want to go.
Then put in “drive” and gently accelerate again.

If you get stuck…

Do NOT spin your tires; this will only dig you in more.
Turn your wheels from side-to-side to push away snow.
Gently accelerate to ease out of the lurch.
Shovel away any snow from tires and under the car.
Keep sand or kitty litter in your trunk for situations like this. Pouring it in the path of your wheels will create traction to move your vehicle.
Try rocking back and forth (if your manual states it's ok to do so. This can harm the transmission on some vehicles).
Shift from forward, then reverse, and then back again. Touch the accelerator each time you're in gear.

Even though there are over 500 vehicles currently at the Detroit Auto Show there is one that most definitely commands more attention than the rest; the 2014 Chevy Corvette Stingray.

The latest news surrounding the car is that the first was sold at auction to NASCAR team owner Richard Hendrick for $1.1 million. The very first Corvette was originally built in Flint, Michigan in 1953. The Stingray was later built in 1963 and was known for its distinctive tapering at the rear of the car. The term “Stingray” has not been incorporated in a Chevy vehicle name since the generation 3 of the Corvette manufactured from 1968-82 in Detroit.

Detroit Auto Show Opens; Cadillac with the Win

The Detroit Auto Show opened this weekend with a bang, and Cadillac goes home with the win, of both North American Car & Truck of the Year.

Automotive journalists, 49 to be exact, named the Cadillac ATS sports sedan as the North American car year and the Cadillac Ram 1500 pickup truck as the truck of the North American truck of the year. All new models were considered and eventually reduced to six finalists.

New Kelsey Law Bans Michigan Teens from Using Cellphone While Driving

Do you have a new teen driver in the house? Then there's a new Michigan law that will affect you and your teen. This past Tuesday Gov. Rick Snyder signed Kelsey's Law, which prohibits new teen drivers from using a cellphone while on the road.

The law was developed in response to the death of Kelsey Dawn Raffaele, a 17-year-old from Sault Ste. Marie. Back in 2010 Kelsey crashed her vehicle while on her phone and attempting to pass another car on icy roads, resulting in her death.

The new law states that drivers with a Level I or a Level II graduated license are banned from holding a cellphone while behind the wheel. There are however exceptions, using the voice operation-hands free option on a phone to make urgent calls such as reporting traffic accidents, crime, or medical emergencies is allowed.

This law accompanies the one already in place in Michigan where all drivers are prohibited from texting and using the internet while driving. For the first offense drivers will be fined $100, any additional will be $200.

Kelsey's mother Bonnie Raffaele has been traveling throughout Michigan since Kelsey's death to speak to high school students about the seriousness of distracted driving. Raffaele has also formed “KDR Challenge”, which not only stands for her daughter's initials, but also “Kids Driving Responsibly.” Raffaele says of the newly signed law, “I know that Kelsey is up in heaven just clapping and screaming for joy over this because of the lives that can be saved through the tragic death of hers,” (New Michigan law prohibits teens from using cellphones while driving, Chad Livengood, Detroit News, http://www.detroitnews.com/article/20130109/POLITICS02/301090358).

Michigan's EIP Course Can Help Your Driving Record

Start off 2013 with an improved Driving Record! Whether you have a few points on your license or received a minor traffic violation the Michigan Education Intervention Program (EIP) can help you obtain a better driving record.

The EIP has created both an in classroom and online program, the Basic Driver Improvement Course, which can help drivers keep points off their license and potentially decrease insurance rates. Those eligible for the course are those that:

Received an eligibility letter from the State of Michigan.
Received a minor traffic ticket (not a criminal offense).
Hold a valid, non-commercial driver's license
Have 2 points or fewer on their driving record.
Received a violation of 3 points or fewer, NOT for careless or negligent driving.
Have NOT completed the program before.
Does NOT have a restricted or suspended license.

Ford & Toyota Recalls

Ford Recall

Ford Motor Company recently recalled 73,320 Escapes and 15,833 Fusions from their 2013s due to overheating that could result in engine fires.

The recalls for both the Escape and Fusion are the SE and SEL models with 1.6-liter engines. All other models of these cars from 2013 with a different engine are exempt from the recall.

Some drivers have reported their vehicle's gauges alerting them of the problem with warnings like “Engine Power Reduced to Lower Temps” and “Engine over temp, stop safely.” Drivers are to contact their dealerships to receive a replacement vehicle at no charge. Toyota Recall

Toyota also had a recent recall of roughly 2.77 million vehicles worldwide, including one of their top sellers, the Prius hybrid, due to steering and water pump issues.

4 Percent Decrease in Michigan Deer-Vehicle Collisions

As most Michiganders know with the crisp air of fall brings wildlife migration, most notably deer which can cause problems for drivers out on the road. However there has been a 4 percent decrease of deer-vehicle collisions within the state from 2010 to 2011.

Last year there were 53,600 collisions which resulted in 1,464 injuries and eight fatalities reports the Michigan Deer Crash Coalition. Michigan gas prices have been skyrocketing, with the average price a gallon this Monday rising to $4.01, the highest it has been so late in the summer since back in 2008. However, relief is on its way in the form of winter weather as gas stations will begin to use winter-grade fuels.

Gas prices are expected to decrease as soon as this week as stations begin the switch. In New York it's already been trading for 20 cents less. As Philip Verleger sees it, founder of PKVerleger, “we're going to see lower gasoline demand. We always do at this time of year. The Make Roads Safe is a coalition that is creating awareness and taking action on preventing road accident fatalities around the world. Founded in 2006 the campaign is funded by the FIA foundation, which is a UK registered charity (No: 1088670) that strives for international road safety.

The campaign was started to help bring awareness to global world safety to civilians to protect, but also to politicians to gain support and funding to prevent future fatalities. The statistics below on global accident injuries and fatalities illustrate the need for funding:

August Auto Sales Up 20% From Last Year's

As the hope for a prosperous economy continues the auto industry reports it has seen a brighter future with a 20% sales increase this month compared to last year's.

Back in August 2011 12.26 million vehicles had been sold whereas come August of this year the total stands at 14.52 million. The reason for a 20% jump is linked to consumers who avoided buying a new car back in 2008 due to the financial crisis.

Whether you'll be the one driving kids to school, your kids, now teens, will be driving themselves to school, or even if you're not a parent, the school season is upon us which means buses will be back out in full force and more traffic on the morning commute. Keep youself and others safe this school season by following these road safety tips.

School buses

Flashing Yellow Lights. When you're approaching a school bus that has flashing yellow lights it is to alert drivers on the road that it preparing to stop to either pick-up or drop of children. Drivers are to proceed with caution.

Flashing Red Lights. A bus using flashing red lights to alert drivers that the bus has stopped and is letting children on or off the bus. Drivers are to STOP. Once the flashing lights are turned off and the bus begins to proceed, it is then ok for drivers to proceed as well. If a driver violates this law there can be serious consequences, such as a traffic fee or even 100 hours of community service to be served at the school. 257.682 Stopping for school bus displaying flashing red lights; exception; violation as civil infraction; meeting stopped school bus on divided highway; evidence; community service.

Sec. 682. (1) The driver of a vehicle overtaking or meeting a school bus which has stopped and is displaying 2 alternately flashing red lights located at the same level shall bring the vehicle to a full stop not less than 20 feet from the school bus and shall not proceed until the school bus resumes motion or the visual signals are no longer actuated. At an intersection where traffic is controlled by an officer or a traffic stop-and-go signal a vehicle need not be brought to a full stop before passing a stopped school bus, but may proceed past the school bus at a speed not greater than is reasonable and proper but not greater than 10 miles an hour and with due caution for the safety of passengers being received or discharged from the school bus. The driver of a vehicle who fails to stop for a school bus as required by this subsection, who passes a school bus in violation of this subsection, or who fails to stop for a school bus in violation of an ordinance that complies with this subsection, is responsible for a civil infraction. (2) The driver of a vehicle upon a highway which has been divided into 2 roadways by leaving an intervening space, or by a physical barrier, or clearly indicated dividing sections so constructed as to impede vehicular traffic, need not stop upon meeting a school bus which has stopped across the dividing space, barrier, or section. (3) In a proceeding for a violation of subsection (1), proof that the particular vehicle described in the citation was in violation of subsection (1), together with proof that the defendant named in the citation was, at the time of the violation, the registered owner of the vehicle, shall constitute in evidence a presumption that the registered owner of the vehicle was the driver of the vehicle at the time of the violation. (4) In addition to the civil fine and costs provided for a civil infraction under section 907, the judge, district court referee, or district court magistrate may order a person who violates this section to perform not to exceed 100 hours of community service at a school.

Make sure to not block crosswalks. They are there to allow pedestrians a safe route when crossing traffic.

Obey school speed limit zones. Children may not stay in the designated crosswalks, so it's important to be at the appropriate speed to give you enough time to react should a child dart in front of your car.

If you have children

Talk to them about traveling to and from school safely. Stress the importance of using the crosswalks and sidewalks.

When traveling with children in the car make sure they are all belted in appropriately. The National Highway Traffic Safety Administration recommends for babies infant-only or rear-facing convertible seats with harness straps at or below the shoulder. Children over one year and between 20-40 lbs should ride in a convertible/forward facing seat with harnesses at or above the shoulders. Children ages eight and older should be in forward-facing booster seats with the seat belt fitting low and tight across the lap or at the upper tight and chest.

Teen drivers

Set restrictions on the number of passengers allowed in the car at one time. According to the Insurance Institute for Highway Safety, just one passenger increases a teen's chance of an accident by 48%.

New Crash Safety Test Challenges Luxury Vehicles

The Insurance Institute of Highway Safety is always striving to test and rate car safety to protect drivers on the road and their newly developed test will further that mission. However, it seems that the top luxury brands are not passing the new test with flying colors.

Ideas for the test came from years of analyzing front end vehicle crashes, which 10,000 people die in a year in the U.S. The new test crashes the front end of the vehicle, about 25% of it, into a 5-foot long barrier while going 40 mph. This is meant to simulate the impact a driver would incur if struck by another car or ran into tree. Eleven 2012 models thus far have underwent this new testing, with only three coming out with good or acceptable results, which are the Acura TL, Volvo S60 and the Infiniti G. Of the other eight, half received moderate ratings and the other half poor. The vehicles that received moderate included Acura TSX, BMW 3 Series, Lincoln MKZ, and Volkswagen CC, those with poor were the Audi A4, Lexus ES 350, Mercedes C-Class, and the Lexus IS 250.

To give you an idea of what constitutes as poor test results the BMW, Volkswagen and Mercedes seat belts all spooled too much therefore resulting in the test dummies smashing into hard interiors. Supreme Court Rules in Favor of Insurers Over Operator Driving a Vehicle Without Permission of Owner

Driving someone else's vehicle without direct permission may not seem like a big deal, however if that quick ride results in an accident it could become a big problem. Recently the Michigan Supreme Court ruled in favor of the insurance companies on two different cases where the drivers got in an accident while driving a vehicle without permission of the owner.

In Kent County a man without a driver's license convinced his girlfriend who was driving his father's car to allow him behind the steering wheel which ended up in a collision. Three Michigan Insurance Companies Approved for Rate Increase

Three different insurers were approved by Michigan state regulators for a rate increase that went into effect the first of this month; Allstate, Fremont, and 21st Century.

The reason for the increased rate is to cover Michigan's no-fault insurance program. Safety on the roads has become a hot topic and with distracted driving becoming a norm, the focus has just begun to shift onto restraining pets while in the vehicle. States are being to take notice and legal action.

It is not uncommon to see a pet riding in a vehicle hanging out the window, sitting on their owner's lap, or even lounging on the dashboard, but Col. Frank Rizzo, superintendent of the New Jersey Society for the Prevention of Cruelty of Animals (NJSPCA) argues that “you wouldn't put your child in the car unrestrained, so you shouldn't put your pet in the car unrestrained, either,” (States unleash laws on restraining pets while driving, Jim Walsh, Phil Dunn, and Alesha Williams Boyd, USA Today,

Rizzo also points out that besides a pet being restrained for their own safety, they should be for the others in the vehicle as animals act like “flying missiles in an impact.” Any object loose in a vehicle can cause potential damage in an accident, so your furry friend could become a projectile object if not restrained.

The AAA, formerly known as the American Automobile Association, reported from their survey conducted in 2010 that 20% of those who took the survey confessed to driving with their dog on their lap, and another 31% were distracted by their dog while driving, (States unleash laws on restraining pets while driving, Jim Walsh, Phil Dunn, and Alesha Williams Boyd, USA Today). The concern here being that a pet not restrained has the potential to cause an accident by distracting the driver from the road.

States have begun to look at creating legislation concerning pet restraint, but some states only have laws in regards to animals being transported in the exterior of the vehicle i.e. in the bed of a pickup truck, but no laws concerning the interior. Currently the states listed below have laws concerning pet restraint:

New Jersey: the NJSPCA has the right to stop a driver if they see unsuitable transportation of any animal. The price range for such a ticket is from $250-$1,000. The driver can also face a disorderly person's offence under animal cruelty laws.

Hawaii: has a law specifically prohibits driving with a pet on one's lap.

Arizona, Connecticut and Maine: can charge drivers for distracted driving if driving with a pet on the lap.

Rhode Island: a proposed legislation has been written by Democratic state Rep. Peter Palumbo to classify driving with a dog on the lap as a distracted-driving violation.

There are a number of pet restraints currently on the market for purchase at pet supply stores as well as online. The three main types of restraints are:

Detroit Auto Show Pushed Back a Week for 2013

Detroit is known for its auto industry, and the crème de la crème of auto shows has been hosted in the city every year since 1989; the North American International Auto Show (NAIAS). The NAIAS will celebrate its 24^th year as a global event in 2013, and the Detroit Auto Dealers Association (DADA) gave some sneak peek details for the Detroit Auto Show 2013 on Thursday.

The event will be pushed back one week later in January 2013 than this year's show. The reason for the change is the desire to not have the show overlap with the Consumer Electronics Show in Las Vegas which typically boasts some auto technologies as well.

Attendees can expect to be ooh'd and ahh'd not only by the always advancing auto technologies at the 2013 show but also the $299 million renovations to the Detroit Cobo Center. The DADA recently signed a five year contract with Cobo, which is proof that after the 2008-2009 recession hit to the industry that the show and the auto industry itself are getting back into the swing of things.

The proof is in the statistics from this year's event generating twice as much media coverage as New York, three times as much as LA and seven times as much as Chicago, according to Rod Alberts, executive director of the NAIAS. In attendance this year were 5,265 media personnel, and 770, 932 public attendees to view the 42 new vehicle models along with the 38 global debuts. With such success it's clear that “we're back where we were four or five years ago…It shows media are coming back, coverage is coming back. Automakers Add Aluminum to Increase Fuel Economy

As the entire car driving world becomes more fuel economy conscious, automakers are gearing their sights on creating the best fuel efficient cars the world has yet to see. How? Aluminum.

Aluminum is a lighter metal which will increase the fuel efficiency of any car which is why auto makers are turning to increase content of it in their new models. President Obama increased the Corporate Average Fuel Economy (CAFE) standard to 35.5 miles per gallon for 2016, and a target of 54.5 miles per gallon for 2025. At first these standards were met with scoff from automakers, but now they're viewing manufacturing in a different light. Money won't be lost as “in the move to 54.5 mpg, the consumer is going to have to pay for a lot of things…turbo chargers cost money, direct injections costs money, 8-speed transmissions cost money, and the aluminum will cost money, so what the automakers are doing is making this trade-off of what's the best bang for their buck in inventing to improve fuel economy,” (Aluminum car doors, frames: Industry's “next frontier': Alcoa, Chris Kelly, Reuters).

As aluminum becomes the material of the future, plastics and titanium will become less proponent. Michigan Accident Victims Can Now Recover More from At-Fault Drivers for Property Damage

A new bill signed by Governor Rick Snyder yesterday would double the cost an at-fault driver is liable for the car repairs or replacement. Currently the limit is $500, this law would make it $500-$1,000.

If you are involved in an accident where the other driver is at fault, that driver, if insured, is only liable to you for up to $500 toward your vehicle damage, under Michigan's “mini tort” law. This leads to a lot of Michigan drivers having to fork over out-of-pocket money to cover larger deductibles after an accident, despite not being at fault. Governor Snyder signed the HB 5362 making the at-fault driver's responsibility to cover costs for car repairs or replacement double -to $1,000.

The BH 5362 is sponsored by Representative Cindy Denby, R-Handy Township, who believes that “despite rising costs the amount residents can collect for damages under the mini-tort provision hasn't been increased in decades. 2013 Models of Lexus Sports Sedan Recalled due to Issue with Steering System

Next month Toyota Motor Corporation will officially be announcing a recall on their Lexus GS 350 Sport Sedan models from 2013. The reason for the recall: there is an issue with the variable-ratio steering system that could potentially cause the driver to lose control of their vehicle.

This recall includes cars that were built from December 12, 2011 to February 7, 2012 and will affect 663 vehicles. The car's electronic control unit or ECU is what controls the variable ratio in the steering system. This model's system could be off-center which could result in an accident for the driver. How? If the car is turned off and in park with the steering wheel turned, when the driver restarts the car the center will be off unexpectedly directing the vehicle in a different course than intended.

This system is becoming a more common feature in vehicles. The basis behind it is that the “front wheels turn farther, faster with less steering-wheel movement at slow speeds, such as when parking or maneuvering in tight spaces. Hot Weather + Hot Car = Car Theft: Don't Let it Happen to You!

The summer months bring beach days, ice cream treats, warm nights around a bonfire, and unfortunately an increase in auto theft!

Did you know that the top 2 months for car theft are July and August? A lot of thefts can be prevented as 40-50% of all car theft is due to driver error reports the National Highway Traffic Safety Administration (NHTSA). We all think it can't happen to us, but every 33 seconds a car is stolen in the U.S. These few simple steps from the NHTSA could deter a thief from going after your vehicle.

 Remove your keys from the ignition and take your keys with you.

 Lock your vehicle.

 Never hide a second set of keys in your vehicle.

 Park in attended lots.

 If you park in an attended lot, leave only the ignition/door key.

 Park in well-lighted areas.

 Never leave your vehicle running, even if you will only be gone for a minute.

 Completely close all vehicle windows when parking.

 Do not leave valuables in plain sight.

 Park with your wheels turned towards the curb to make your vehicle more difficult to tow away.

 If your vehicle is rear-wheel drive, backing into your driveway will also make it more difficult for a thief to tow it away.

 Garage your vehicle if you have one and always remember to lock the garage door.

 Do not leave the registration or title in your vehicle.

 Always use your emergency brake when parking, which ensures safety and also makes it difficult for a thief to tow your vehicle away.

 Etch your vehicle identification number on car windows and major parts. This procedure makes vehicles and parts more easily traceable when stolen.

 Disable your vehicle when leaving it unattended for an extended period of time.

 Engrave expensive accessories like car stereos, cellular phones, compact disc changers, external speakers, etc., so that the thief will have difficulty disposing of them.

 Drop business cards, address labels or other identification inside vehicle doors to help assist law enforcement in identifying your vehicle or parts.

 Replace easily accessible door lock assemblies.

May is Motorcycle Safety Awareness Month

May is Motorcycle Safety Awareness Month! And even if you don't ride a motorcycle yourself, you DO share the road with them. Here are some safety reminders to keep you and others safe on the road!

A motorcycle IS a vehicle with all rights and privileges of any other motor vehicle.

Be sure to give a motorcycle the full lane width.

Always scan the road for motorcycles by checking your mirrors and blind spots when at intersections, making turns, and before switching lanes.

Make it a habit to always use your turn signal to alert others on the road of your intentions.

A flashing signal on a motorcycle could be the motorcyclist's way of signaling a turn OR it may be a feature of the bike. Flashing headlights are becoming more common to make the bike more visible to other motorists on the road. So always use caution and wait to see if the motorcyclist intends to turn at the intersection or not.

Never tailgate a motorcycle (or anyone for that matter!) Give them room to maneuver.

Try your best not to become distracted while driving. This is important for you and everyone else on the road. (Remember last month was Distracted Driving Awareness Month!)
